Joint CAC, NDRC and MIIT implementation opinions published 8 May 2026 define AI agents, set four guiding principles, and organise work under technology foundations, safety, nineteen application scenes and an innovation ecology. The document is policy guidance, not a standalone statute.

What this instrument is

Fact

On 8 May 2026 the Cyberspace Administration of China published the Implementation Opinions jointly issued with the National Development and Reform Commission and the Ministry of Industry and Information Technology.

The lead defines an AI agent (智能体) as an intelligent system with autonomous perception, memory, decision, interaction and execution capabilities, and an important form of AI products and services. The opinions are framed as implementing the State Council’s deeper “AI+” action opinion.

Standing is guidance issued 8 May 2026. Concrete justiciable duties still arrive through later laws, standards, filing and sector rules.

How the instrument works

Mechanism

Section I sets four principles: safety and controllability as a baseline across research, deployment and promotion; orderly governance linked to existing law and industry self-regulation; innovation-driven breakthroughs in key agent technologies and open ecosystems; and application pull through typical scenes, easy first then hard.

Section II (foundations) calls for stronger base models and specialised models, high-quality datasets, agent task understanding, planning, tool use, long-term memory and multi-agent collaboration; an agent tool chain covering perception through execution plus security tools; a standards system spanning key technologies, products, data exchange, evaluation, safety and trusted certification, including promotion of agent interconnection protocol (AIP) standards; and exploratory work on an “intelligent internet” architecture with agent registration, digital identity and monitoring indicators.

Section III (safety) requires clearer policy, ethics and decision-permission boundaries so users keep informed consent and final decision rights; behaviour controls and verifiable traces in important scenes; endogenous security and supply-chain controls; and a classified, graded governance frame: sensitive and key sectors may face filing, testing and recall measures jointly set by cyberspace and sector authorities, while lower-risk life and office uses lean on self-testing, reporting, distribution-platform management and industry self-regulation. Industry associations are pushed toward self-regulatory rules and voluntary credit evaluation.

Section IV lists nineteen numbered typical application scenes across scientific research, industry, consumption, livelihood and social governance (items 15–33), from research exploration and manufacturing through finance, education, health, government services, justice, public safety, urban governance and bidding.

Section V covers open-source agent work, industry collaboration platforms, software stores and scene opening, plus overseas compliance for exporters. Section VI assigns CAC, NDRC and MIIT, with other bodies, to coordinate policy, evaluation indicators, monitoring and rolling adjustment.

Who writes and who is steered

Fact

CAC, NDRC and MIIT jointly issue the opinions and are named to coordinate implementation with other bodies.

Developers, deployment platforms, distribution platforms and service providers are the main addressees of product criteria, platform rules and credit-evaluation language. Sector regulators appear for sensitive-industry filing and testing under item 11.

What the guidance is not

Analysis

This is not an EU-style horizontal AI Act and not itself a synthetic-content labelling statute. Labelling duties for synthetic content sit in the separate 2025 Measures.

Reading the opinions as creating immediately justiciable private rights overstates the document type. Item 11’s filing, testing and recall language points to later administrative measures keyed to scenes and sector rules.

The opinions are policy guidance. Binding product duties, mandatory standards and filing mechanics arrive in later instruments and standards under Sections II–III.

The nineteen scenes are directional application priorities, not an exhaustive permit list. Scene-specific regulators still set openable uses in sensitive sectors.
